The Bixby Municipal Court at 116 W. Needles Ave. handles traffic citations and city ordinance violations only. It has no probate function at all. Estate administration, will filings, and guardianship cases never go through municipal court. All of that work goes to the appropriate county district court.

Both Tulsa County and Wagoner County court clerk offices are open Monday through Friday. Tulsa County is a larger court system with more staff. Wagoner County in the town of Wagoner is smaller but fully equipped to handle all standard probate work.

Types of Bixby Probate Records

Both Tulsa County and Wagoner County District Courts handle the same categories of probate cases. Estate cases are the most common. When a person dies with assets, a family member or creditor files a petition to open the estate. The file includes the original will if one was left, an inventory of assets, notices to creditors, accountings from the personal representative, and a final decree distributing property to heirs.

Guardianship and conservatorship cases also appear in the probate docket. These proceedings involve court-appointed oversight for a minor or an adult who cannot manage their own finances or personal care. The records include petitions, home studies, annual accountings, and court orders. Most probate records are public, with limited restrictions on materials involving minors.

Will deposits under 84 O.S. § 81 allow any person to store a will at the court clerk's office before they die. These sealed wills become public only after the person passes and probate is opened. If you believe someone deposited a will at either Tulsa or Wagoner County, you can ask the clerk to check after the person has died.

Filing Probate for a Bixby Estate

Probate starts with a petition under 58 O.S. § 22 filed at the appropriate district court, either in Tulsa or in Wagoner. You pay the $204.14 filing fee when you submit the petition. The court assigns a case number and schedules a hearing. Bring the original will if one was left. Without a will, you file for letters of administration instead.

After the petition is accepted, Oklahoma law requires notice to creditors under 58 O.S. § 241. The notice must be published in a local newspaper for two consecutive weeks. Creditors then have two months from the first publication to file claims. Newspaper fees typically run $100 to $200.

Once the creditor period closes, the personal representative files an inventory of the estate's assets. The case moves through accountings and court hearings before a final decree is issued distributing property to heirs. Standard estates close in six months to a year. Complex or contested cases take longer.

Under 58 O.S. § 331, estates worth $50,000 or less can use a small estate affidavit with no court fee, after a 10-day waiting period. For estates worth $200,000 or less, or where the decedent has been dead for at least five years, 58 O.S. § 901 allows summary administration as a faster alternative to full probate.

Bixby Probate Fees and Copies

The base filing fee for a probate petition at either Tulsa or Wagoner County is $204.14. Guardianship and conservatorship filings cost the same. Relative guardianship petitions cost $67.00, reflecting the lower bar the law sets for family placements.

Copies cost $1.00 for the first page and $0.50 per additional page under 28 O.S. § 31. Certified copies add $0.50 per document. Authentication for out-of-state use adds $5.00 to $7.00. A staff search fee of $5.00 to $10.00 may apply if you do not have a case number and need clerk assistance to locate a file.

You can request copies in person at either courthouse during office hours. Mail requests are also accepted. Include the case number, party names, approximate filing year, and a check or money order payable to the appropriate county court clerk. Copies are mailed back when the request is fulfilled.

Public Access to Bixby Probate Records

Oklahoma's Open Records Act, 51 O.S. § 24A.1, makes most probate court records open to the public. You do not need a reason to request records, and you do not need to be a party to the case. Estate petitions, wills, inventories, accountings, and final decrees are all accessible. Some sealed exhibits or records involving minors may be restricted by court order.

Tulsa County has a large volume of probate cases going back decades, most of which are searchable through OSCN. Wagoner County records are also available through OSCN. For either county, older files may require an in-person visit or written request. Call the relevant clerk before visiting if you are searching for records from a specific older time period.
