What Shawnee Probate Records Contain

Probate records filed at Pottawatomie County District Court cover estate cases, guardianship and conservatorship matters, and will deposits. Estate cases are the most common. When a person dies, a family member or interested party files a petition to open the estate. The file grows to include the original will if one was left, an inventory of assets, notices to creditors, accountings from the personal representative, and a final decree closing the estate and distributing property to heirs.

Guardianship and conservatorship cases involve court-appointed oversight for minors or adults who cannot manage their own finances or personal care. The records include petitions, guardian suitability reviews, annual reports, and judge's orders. Most of these files are public, with limited restrictions on portions involving minors.

Will deposits under 84 O.S. § 81 allow any person to leave a will with the court clerk for safekeeping before they die. These wills remain sealed and private until death and the opening of probate. If you believe a Shawnee resident deposited a will at Pottawatomie County, you can ask the clerk to check after the person has passed.

How Probate Works in Shawnee

Probate starts with a petition filed under 58 O.S. § 22 at the Pottawatomie County District Court on N. Broadway. You pay the $204.14 filing fee when you submit the petition. The court assigns a case number and schedules a hearing date. If a will exists, bring the original with the petition. Without a will, file a petition for letters of administration.

After the petition is filed, notice to creditors is required under 58 O.S. § 241. The notice must be published in a local newspaper for two consecutive weeks. Creditors have two months from the first publication date to file claims. Newspaper fees typically run $100 to $200 depending on the publication used.

After the creditor period, the personal representative files an inventory of estate assets. The case moves through accountings and hearings, and eventually the court issues a final decree distributing property to heirs. A standard estate takes six months to a year from filing to close.

Under 58 O.S. § 331, estates worth $50,000 or less can skip formal probate using a small estate affidavit at no cost, after a 10-day waiting period. Estates worth $200,000 or less, or those where the decedent has been dead at least five years, may qualify for summary administration under 58 O.S. § 901, which is faster than a full probate case.
